Openness of HZN’s work

Article 12 of the Act on the Right of Access to Information (Official Gazette 25/201385/201569/2022) requires public authorities to inform the public about their work. As detailed in its paragraph 1, this includes the agendas of meetings and sessions of official bodies and their scheduled times, manner of work and possibilities of direct insight into their work, and the number of persons who may simultaneously receive direct insight into the work of the public authority bodies, taking account of the sequence of registration.

Paragraph 2 of that Article provides for an exception to the application of this requirement: public authorities are not required to provide direct insight into their activities in matters from which the public should be excluded, i.e., if such information is subject to access restrictions pursuant to the provisions of this Act, such as confidential information, personal data or information subject to other restrictions prescribed by the Act, or if the relevant legislation stipulates that decisions are to be taken in non-public sessions. This provision provides for a partial exclusion of the public from the closed part of a session when matters are discussed in respect of which there are legal restrictions on public assess.

The openness obligation means that representatives of the public have the right to attend sessions with prior notice, however, they shall not disturb a session and shall not have the right to participate in its work or a debate and to express their views and opinions during the session. If a representative of the public disturbs a session, he/she shall be evicted from the session.

A session of HZN's Administrative Board may be attended by no more than one representative of the public. Natural persons or legal entities shall send their request to attend a session on the “Request for Attending an Administrative Board Session” form at least three days in advance by e-mail at pristupinfo@hzn.hr.
